1. About these Terms
These Terms govern your access to and use of Lumashot's website, mobile applications, and related services (the "Service"). By using the Service, you agree to these Terms.
If you use the Service on behalf of a company or organization, you confirm that you are authorized to bind that entity to these Terms.
2. Eligibility and Account Registration
You must be legally able to enter into a binding agreement in your jurisdiction to use the Service.
You may use the Service with or without an account where available. Some features may require account registration and sign-in.
You are responsible for keeping your login credentials secure and for activity that occurs under your account.
3. The Service
Lumashot provides tools to organize photos, generate layouts, and create photo products. Features may vary by device, region, and release stage.
We may add, remove, or update features over time to improve performance, security, legal compliance, or user experience.
4. Your Content
You retain ownership of photos, text, and other content you upload or submit through the Service ("User Content").
You grant Lumashot a limited, non-exclusive license to host, process, transmit, and display User Content only as necessary to operate the Service and fulfill your requests.
You are solely responsible for your User Content and for ensuring that you have all rights and permissions needed to upload, process, print, and share it.
You must not upload unlawful content, content that infringes third-party rights, or content that contains malware or other harmful code.
5. Collaboration and Sharing
If you share project links or invite collaborators, anyone with access may be able to view or edit the relevant content depending on the permissions of that feature.
You are responsible for how you share access and for disabling shared access when no longer needed.
6. Acceptable Use
You agree not to misuse the Service, including by attempting unauthorized access, interfering with platform security, scraping where prohibited, or using the Service to violate law.
We may suspend or restrict access if we reasonably believe there is abuse, security risk, legal risk, or a breach of these Terms.
7. Availability, Maintenance, and Updates
The Service is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation.
Scheduled or emergency maintenance, technical outages, and third-party dependencies may affect availability.
You are responsible for maintaining your own backups of important content.
8. Orders, Pricing, and Payments
If you order physical or digital products through Lumashot, pricing, taxes, shipping fees, and delivery windows are shown at checkout.
By placing an order, you confirm that your order details are accurate and that you are authorized to use the selected payment method.
Personalized products may be non-cancelable or non-refundable once production has started, except where mandatory law provides otherwise.
9. Intellectual Property
Lumashot and its licensors own the Service, including software, design, branding, and non-user content, and reserve all rights not expressly granted.
Except as permitted by applicable law, you may not copy, modify, reverse engineer, distribute, or create derivative works from the Service.
10. Third-Party Services and App Stores
The Service may integrate third-party services. Your use of third-party services is governed by their own terms and privacy policies.
If you download the app from Apple App Store or Google Play, those platforms may impose additional terms that apply to your use of the app.
11. Privacy and Data Processing
Our handling of personal data is described in our Privacy Policy.
Where we process personal data on your behalf (for example, content you upload that contains personal data), a separate data processing addendum may apply.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.
Color rendering, cropping, and print output may vary due to screen settings, production methods, paper type, and fulfillment partner differences.
13. Limitation of Liability
To the maximum extent permitted by law, Lumashot is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity.
To the maximum extent permitted by law, Lumashot's total liability for claims relating to the Service will not exceed the greater of: (a) amounts you paid to Lumashot in the 12 months before the claim; or (b) USD 100.
Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Termination
You may stop using the Service at any time. Where account deletion is available, you may request deletion through in-app/account settings or by contacting support.
We may suspend or terminate access for breach of these Terms, legal requirements, safety reasons, or prolonged inactivity where permitted by law.
Sections that by nature should survive termination (including ownership, disclaimers, liability limits, and dispute terms) will survive.
15. Changes to these Terms
We may update these Terms from time to time. Material updates will be communicated through the Service or other reasonable channels.
Your continued use of the Service after an effective date means you accept the updated Terms, unless applicable law requires a different process.
16. Governing Law and Disputes
These Terms are governed by the laws stated in your local terms notice or at checkout, without prejudice to mandatory consumer protections in your place of residence.
